1.- General Information

The website [www.perfumesloewe.com] (hereinafter, the "Website") is operated by PERFUMES LOEWE S.A., a Spanish company domiciled in Madrid, calle Isla de Java número 33, telephone +34 91 728 6900, registered in the Commercial Registry of Madrid, Volume 10,190, folio 183, sheet number M-91.860, and holder of Tax ID number A-79287124 (hereinafter, "PERFUMES LOEWE").

For the REST OF THE WORLD, GLOBAL-E FRANCE SAS. (a French company referred to as "Global-e", "we", "our" or "us"), with its registered office at rue Saint-Honoré, 75001 Paris, France, is the partner that facilitates sales and fulfilment for the retailer operating the e-commerce website ("Website"), where products are made available for purchase through the website and delivery ("Merchandise"). Perfumes Loewe ("Distributor") has an agreement with Global-e, allowing it to act as a registered merchant on behalf of Global-e and on behalf of the Distributor. The Website is the exclusive property of PERFUMES LOEWE, S.A., which is the sole entity authorised to use and exploit the intellectual property rights and personal rights relating to this Website, in particular trademarks, designs and models, copyright and image rights, by original title or by virtue of an express, patent authorisation and any other intellectual property right.

2.- Website Terms of Use

Both browsing the Website and the use of its contents are subject to these Terms of Use of PERFUMES LOEWE (hereinafter, "Terms of Use"). The act of accessing and browsing this Website constitutes on the part of the user an unreserved acceptance of everything contained in the Terms of Use.

These Terms of Use, as well as the General Contracting Conditions (hereinafter, the "Conditions"), are intended to regulate the use of the Website, the provision of information supplied in the online store at [www.perfumesloewe.com], as well as the commercial transactions arising between PERFUMES LOEWE and the users of the domain [www.perfumesloewe.com].

PERFUMES LOEWE may modify the Website and/or the Conditions to make such changes and modifications as it deems appropriate and necessary for the proper functioning thereof, without prior notice; therefore you must read the Conditions before placing each order.

All users of the Website may print and/or save these Conditions in electronic format for a more detailed reading of our Conditions.

Both browsing the online store and the purchase of any of the Products offered therein imply acceptance by the user, without reservation of any kind, of each and every one of these Website Terms of Use and General Contracting Conditions, as well as the Privacy Policy and the Cookie Policy.

The use of all or part of the Website, in particular for downloading, reproducing, transmitting or representing for purposes other than personal, private and non-commercial use, is strictly prohibited.

PERFUMES LOEWE strives to ensure the accuracy and currency of the information published on the Website, reserving the right to correct its contents at any time.

PERFUMES LOEWE shall not be liable:

(i) for any inaccuracy, inexactitude, omission or any damage resulting from the intrusion of a third party who has modified the information contained on the Website.

(ii) in the event of damage caused by the access of an unauthorised third party to the Website or preventing access thereto. The user may be invited to provide their personal data.

The user is informed that the provision of personal data is optional and allows PERFUMES LOEWE only to have a better knowledge of the users of its Website in order to better meet their expectations and to be able to send them, if they so request, information relating to Products or services of PERFUMES LOEWE.

PERFUMES LOEWE will implement all technical and organisational means designed to ensure the security and confidentiality of files created on the basis of personal data collected through the Website. However, PERFUMES LOEWE does not control all the risks associated with the use of the Internet and reminds users of the existence of possible risks inherent in its use.

PERFUMES LOEWE disclaims any liability relating to the content of other pages linked to the Website.

PERFUMES LOEWE informs users of the Website that the Terms of Use may be modified at any time. These modifications will come into force from the moment of their publication on the Website and will be deemed accepted without reservation by any user who accesses the Website after such publication. Consequently, it is the responsibility of each user, before browsing the Website, to carefully read the Terms of Use.

The user is informed that access to the Website may be interrupted at any time by PERFUMES LOEWE for reasons of maintenance, security or any other cause.

3.- General Purchase Conditions

We invite you to review the general contracting conditions that regulate the offer and sale of PERFUMES LOEWE products (hereinafter, the "Products") through the e-shop included on this website [www.perfumesloewe.com] (the "Website"). The ownership of the domain of our virtual store, [www.perfumesloewe.com], belongs to PERFUMES LOEWE, S.A. and all Products offered on the Website are sold directly by PERFUMES LOEWE S.A.

3.1 General Purchase Conditions in Spain.

3.1.1 Purpose and scope of application

These General Contracting Conditions are intended to regulate the provision of information supplied in the online store at [www.perfumesloewe.com], as well as the commercial transactions arising between PERFUMES LOEWE and the users of the domain [www.perfumesloewe.com].

All users of the Website may print and/or save these Conditions in electronic format for a more detailed reading of our Conditions.

3.1.2 Placing an Order

To place an order it is necessary to connect to the Website and register as a user or, alternatively, make the purchase as a guest without registering as a user, completing in both cases the electronic form that appears on the Website at any given time and following the instructions indicated on the Website.

The prices and offers presented on the Website are valid solely and exclusively for online orders placed at www.perfumesloewe.com, and may not coincide with the prices and offers in force from other distributors of the Products. All prices published on the Website are in euros and include taxes.

PERFUMES LOEWE only sells to consumers through the website. Products are for the personal use of the consumer, excluding any connection with their professional capacity. Consequently, any order exceeding five (5) units of the same reference will not be accepted and is presumed not to correspond to personal use by the consumer. Orders exceeding 2,999 euros, including VAT, will also not be accepted.

Validation of the order on your part expressly implies knowledge and acceptance of these Conditions as part of the conclusion of the contract. Unless proven otherwise, the data recorded by the Website constitutes proof of all transactions carried out between PERFUMES LOEWE and its customers. PERFUMES LOEWE will archive the electronic document formalising the contract and this will be accessible.

Once the purchase has been made and as soon as possible, always within 24 hours of the execution of the purchase, the Customer Service Department of PERFUMES LOEWE will send you a purchase confirmation by e-mail. If you do not agree with the data contained in said confirmation, you may request its modification or the cancellation of the contract.

To proceed with the purchase of Products, you must add the Product you wish to purchase to the basket, following the instructions shown on screen, completing the order form provided and validating it. If you require a full invoice, you must select the "I want an invoice" option that appears on the purchase form, so that we can contact you by email to obtain your tax details and send you the full invoice by the same means or, where applicable, by post.

3.1.3 Product Availability

The selection of Products offered at www.perfumesloewe.com is valid as long as the Products are visible on the Website and as long as PERFUMES LOEWE has stock available. As this is an e-commerce business, stock is updated online, so it may occasionally happen that stock runs out during the purchase process, making it impossible to continue with the purchase initiated.

In the event of a stock shortage or temporary unavailability of a Product, PERFUMES LOEWE will contact you to inform you and provide a new delivery date or, if it is not possible to supply said Product, proceed with its cancellation.

PERFUMES LOEWE reserves the right to modify, at any time and without prior notice, the Products presented on the Website.

3.1.4 Order Confirmation

Following confirmation, your order will be sent to PERFUMES LOEWE for processing. Your order may not be modified or cancelled except in accordance with the Conditions or with the provisions established under Spanish common law.

Confirmation of your order will signify acceptance of all the Conditions. A summary notification of the main details of the order will be sent to you.

3.1.5 Payment Methods

The prices of LOEWE Products are set in Euros, including taxes.

PERFUMES LOEWE reserves the right to modify, at any time and without prior notice, the prices of Products on the Website (not applicable to orders already placed). The billing of Products will be based on the price list included on the Website at the time of confirmation of your order, subject to the availability of the Products requested at that time.
Any order placed on the Website must be paid immediately upon confirmation of your order.

We only accept payments by credit or debit card or through the PayPal payment system. In this regard, payments through the Website will be processed online with the corresponding bank. The said bank will be responsible for storing and automatically processing, in a secure environment, the information relating to the different orders, including bank card details, all in accordance with Regulation (EU) 2016/679 (GDPR), on the protection of personal data.

Orders will be paid in Euros. Payments must be made by Mastercard®, Visa®, American Express® or PayPal account. Your order will be processed once the entire purchase process has been completed and payment has been made.

If any of the Products requested are not available (see "Product Availability"), the customer will be informed of alternatives or similar products and, should they choose to withdraw from the purchase, PERFUMES LOEWE will refund to the card or PayPal account used for payment the amount of the Products not sent, it being understood that the order has been cancelled.

3.1.6 Product Delivery

Delivery Address

The Product(s) purchased through the Website may only be delivered to the Delivery Zone specified during the purchase process.

Any delivery address located outside Spain will be processed through our partner Global-e.

No request will be processed where a PO box is provided as the delivery address.

Merchandise will be sent to the postal delivery address in the Delivery Zone specified in the order.

3.1.7 Delivery Times

The delivery period will be between 1 and 2 working days for Spain. For the calculation of delivery times, Saturdays, Sundays, national public holidays, public holidays in the Community of Madrid or in the Autonomous Community where the ordered Products are to be delivered shall not be considered working days. The delivery period for the rest of the Delivery Zone will be shown during the purchase process before order confirmation. Delivery of the ordered Products will take place during normal working hours at the address indicated when placing the order, subject to payment confirmation. No delivery will be made until payment for the Products has been received.

3.1.8 Delivery Issues

You must notify PERFUMES LOEWE as soon as possible through the "Contact us" tab on the Website of any cases of non-receipt of the Product or delivery delays exceeding eight (9) working days.

If there is no one at the indicated address to accept delivery of the Products, the courier company will contact you to arrange a new delivery date or collection point for the Products.

Every effort will be made to deliver the Products as soon as possible after the order has been accepted. When the order is delivered to you, you must check that the shipment is correct.

If there is any discrepancy or problem with your order at the time of delivery, we advise you to note the nature of the discrepancy or problem (for example, open package, damaged goods) on the delivery note and sign it. You must then contact the Online Orders Department by email through the "Contact us" section of the Website.

At the time of acceptance and delivery, both ownership of the Products and the risk of associated damage will be transferred to you.

If the merchandise does not correspond to your order or you are not satisfied with it, you may exchange it for other items or return it and request a refund in accordance with the terms and conditions contained in the section entitled "Returns Policy".

3.1.9 Shipping Costs

Shipping and/or handling costs are included in the price of the Product for all shipments made within Spain.

3.1.10 Right of Withdrawal

If you are not satisfied with the Products purchased through our website www.perfumesloewe.com, you have the right to withdraw from the contract by returning your purchase to our own online store, in accordance with the provisions set out in the following paragraphs. The right of withdrawal may be exercised, without the need for justification, within a period of fourteen (14) calendar days from the date of receipt of the product. For the calculation of the period, the date indicated by the carrier as the date of receipt of the goods by the consumer shall apply.

In accordance with the provisions of Directive 2011/83/EU of the European Parliament and of the Council of 25 October 2011 on consumer rights, the Customer may exercise their right of withdrawal within fourteen (14) days from the date of receipt of the Products, notifying PERFUMES LOEWE of their decision to withdraw through:

- An unequivocal statement, including the reference and the number of Products being returned, by any means

- The online withdrawal function available on the website through the "Withdrawal Request" button located in the footer. Should the Customer use this function, PERFUMES LOEWE will send them, without undue delay, an acknowledgement of receipt of the withdrawal on a durable medium (for example, by email), including the content of the request and the date and time of submission.

- The Returns Form made available to the Customer, duly completed to clearly express the Customer's decision to withdraw from the contract, and sent to the email address eshoploewe@perfumesloewe.com of our Online Orders Service. You may download the Returns Form at this LINK.

Products must be returned in their original condition along with any accessories related to the Products (including promotional gifts). Please note that, in accordance with applicable regulations, the statutory right of withdrawal will not apply to products made to the consumer's and user's specifications or that have been personalised at the customer's request (such as bottle engraving and similar).

The Customer Service Department of PERFUMES LOEWE, upon receipt of the Withdrawal Request, will contact the customer to arrange collection of the order.

PERFUMES LOEWE may determine whether the Products are in the same original condition when returned. Products that are returned incomplete, spoiled, damaged, deteriorated or used by the Customer may, depending on the specific case and in accordance with applicable regulations, be subject to a reduction in their refund or may not be refunded and may be made available to their sender or returned at the sender's expense, at PERFUMES LOEWE's discretion.

In the event that the right of withdrawal is exercised, we will refund all payments received from you, including delivery costs (except in cases where the customer has opted for a more expensive delivery method than the standard one), in any case no later than fourteen (14) working days from the date on which you inform us of your decision to withdraw from the contract.

However, the refund may be withheld until we have received the goods, or until the consumer and user has provided proof of the return thereof, whichever occurs first. Said refund will be made using the same payment method used for the purchase, once the Product has been received. Should you wish to return the product by a means other than that offered by PERFUMES LOEWE, PERFUMES LOEWE will not bear the cost of such return nor will it be liable or obliged for the loss, delivery to an incorrect address or delay in the delivery of any item you wish to return to the Website, as the risks of the transport method chosen by you are borne by you.

The Customer will be responsible for obtaining proof of the return of the Products by sending them by registered post or other means that provides proof of the date of postage and delivery.

The right of withdrawal regulated in this section will only apply to Products purchased solely and exclusively through www.perfumesloewe.com, and will therefore not apply under any circumstances to Products purchased in a physical store.

3.2.- Terms of Sale for INTERNATIONAL ORDERS

4.- Intellectual Property

The Website is an original creative work protected by intellectual property protection laws. The page, as well as all the elements that compose it, are the exclusive property of PERFUMES LOEWE. The reproduction or representation, in whole or in part, of the page or any of the elements that compose it, as well as its modification, is strictly prohibited. The trademarks and domain names that appear on the Website are the exclusive property of PERFUMES LOEWE. Any unauthorised reproduction or use of these trademarks or domain names, regardless of the form or intention they take, is strictly prohibited.

PERFUMES LOEWE has taken all reasonable steps to ensure that the information obtained through its Website is accurate. However, it does not in any way guarantee the accuracy, completeness or currency of said information. PERFUMES LOEWE, S.A. does not grant any kind of warranty, express or implied, in relation to all or part of its Website. PERFUMES LOEWE will not be liable in any case for any direct or indirect damage, whatever its nature, arising from the use of its Website.

All material contained on the website www.perfumesloewe.com (drawings, source codes, designs, illustrations, images, photographs, soundtracks, written texts, logos, trademarks and other distinctive signs appearing thereon) are the exclusive property of PERFUMES LOEWE or any of its subsidiaries and are protected by the corresponding intellectual and industrial property rights. Their use, total or partial reproduction, distribution, public communication, transformation or any other similar or analogous activity is strictly prohibited, unless prior written authorisation from PERFUMES LOEWE has been obtained. The licence to use any content of the Website granted to the user is limited to the download of said content by the user and its private use, provided that the said contents remain intact. In the event that any user observes outdated, inaccurate or erroneous content, they must report this through the channels established in section 1 of this Legal Notice.

PERFUMES LOEWE disclaims any liability for any damages and losses that may be caused by the lack of availability and/or continuity of the Website and/or the services offered therein.

PERFUMES LOEWE does not guarantee the absence of viruses or other elements on the Website that may cause alterations to your computer system. PERFUMES LOEWE, S.A. disclaims any contractual or non-contractual liability with the person or company making use thereof who suffers damages of any nature caused by computer viruses or computer elements of any kind.

PERFUMES LOEWE shall not be liable: (i) for any inaccuracy, inexactitude, omission or any damage resulting from the intrusion of a third party who has modified the information contained on the Website, nor (ii) in the event of damage caused by the access of an unauthorised third party to the Website or preventing access thereto.

6.- Legal Guarantee

Consumers who are residents of the European Union will have a legal guarantee of two (2) years from the date of delivery of the Product, for the repair or replacement of Products that are defective or do not conform to those advertised. You may request a refund or reduction in the price of the Product when repair or replacement has not taken place within a reasonable time or without major inconvenience to you.

8.- Applicable Law and Jurisdiction

These General Conditions are governed by Spanish law. However, this choice of law will not deprive the consumer of the protection afforded by the mandatory provisions of the law of the country of their habitual residence that cannot be excluded by agreement and that would have been applicable in the absence of this choice.

For the resolution of any dispute arising from this contract, the consumer may bring their action before the court of the place of their domicile.

Likewise, as an entity adhered to Confianza Online and under the terms of its Code of Ethics, in the event of disputes relating to online contracting and advertising, data protection and the protection of minors, the user may resort to the extrajudicial dispute resolution system of Confianza Online (www.confianzaonline.es).

Users may also make use of the online means provided by the European Union for online dispute resolution (https://webgate.ec.europa.eu/odr). Complaints forms are also physically available to customers upon request at Isla de Java 33, Madrid or by email at contact@perfumesloewe.com.
